Section 341 Meeting of Creditors
The United State’s Trustee holds a meeting of creditors 20 to 40 days after the order for Chapter 7 Bankruptcy relief. The debtor must appear at the meeting of creditors. The bankruptcy judge does not attend. The Chapter Trustee must examine the debtor under oath with regarding to the information listed in the debtor’s petition and schedules. Creditors have the right to appear and question the debtor. If creditors would like to examine the debtor further, they can move the court for an order granting a 2004 examination. These additional examinations are rare in that most debtors do not have assets available to creditors and most debtors have not engaged in any kind of fraud.
